Acceptance of Terms

By downloading, installing, or using the CastIQ mobile application or website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Service Description

CastIQ is a fishing intelligence platform that aggregates stocking reports, lake survey data, weather conditions, and fishing insights for anglers across the United States. The Service is provided for informational and recreational purposes only.

Eligibility

You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to use the Service. By using CastIQ you represent that you meet this requirement.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and current registration information
• Notify us immediately of any unauthorized account access
• Not share your account with any third party
• Not use the Service to violate any applicable law or regulation

Subscriptions and Payments

CastIQ offers free and paid subscription tiers. Paid subscriptions are available through:

• Apple In-App Purchase — managed through your Apple ID and subject to Apple's payment terms. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period in your Apple ID account settings.
• Stripe — for web-based subscriptions, billed to a credit or debit card.

All fees are stated in US dollars and are non-refundable except as required by applicable law or as required by Apple's standard refund policies. We reserve the right to change pricing with reasonable advance notice.

Acceptable Use

You agree not to:

• Scrape, crawl, or automatically download data from the Service in bulk
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to transmit spam, malware, or unlawful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service for any commercial purpose without our prior written consent

Intellectual Property

All content, trademarks, logos, and data provided through the Service are the property of CastIQ or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. Stocking and survey data is sourced from state and federal agencies and is used in accordance with applicable terms.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT FISHING DATA WILL BE ACCURATE, COMPLETE, OR CURRENT AT ALL TIMES.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CASTIQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold CastIQ and its officers, directors, employees, and agents harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with or without notice. You may cancel your account at any time through the app settings.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, USA, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Wisconsin.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the app or email. Continued use of the Service after changes constitutes acceptance of the revised Terms.
